No New Trial In West Memphis Three Case


Jonesboro - Two of the men convicted of killing three West Memphis boys will not receive a new trial.

Judge David Burnett turned in his ruling Wednesday morning at the Craighead County Courthouse.

Jason Baldwin and Jessie Misskelly are both serving life sentences for the 1993 killing of three West Memphis boys. The two men claimed they received inadequate counsel during their trial previous trial and requested a new trial.

The men and their attorneys claimed new DNA evidence not available in 1993 helped prove their innocence.

JONESBORO, AR (KAIT) Two men convicted of killing three West Memphis boys will not receive a new trial.

Judge David Burnett turned in his ruling Wednesday morning at the Craighead County Courthouse.

Jason Baldwin and Jessie Misskelly are both serving life sentences for the 1993 killing of three West Memphis boys. The two men claimed they received inadequate counsel during their previous trial and requested a new trial.

The men and their attorneys claimed new DNA evidence not available in 1993 helped prove their innocence.

A third man Damien Echols is on death-row for the killings.  Echols' appeal for a new trial was dismissed last year.  Much of Echols' request for a new trial also centered on inadequate counsel and new DNA evidence.

Region 8's Josh Harvison was with Judge Burnett when he handed down his decision and will have more details in a live report on Region 8 News at 5 and 6.

  I thought he might try to save his career, but I guess he sealed his fate when he denied Damien's bid for a retrial.

    If he had granted Jason and Jessie's motions....what would he do with Damien?

  I hope Burnett included this in his official decision:


The judge also rejected Baldwin’s claims that animals — likely turtles — caused multiple injuries to the boys’ bodies. Burnett noted that the medical examiner who performed the autopsies was a turtle expert who said the injuries were caused by a knife.

    I think all appeals must be denied in State Court before any motions can be considered in Federal Court.  So...I would imagine that the ASSC would need to deny the juror misconduct issue and all other issues.... before Judge Miller can straighten out these embarrassingly backward dumb-asses.

Judge says no new trial for Jason Baldwin in WM3 Case

A judge in Craighead County has refused to grant a new trial for Jason Baldwin -- one of the three men convicted in the 1993 killings of three young West Memphis boys.

Circuit Court Judge David Burnett issued an order Wednesday rejecting Baldwin's claims that he wasn't adequately represented at trial. Baldwin was convicted along with Damien Echols and Jessie Misskelley in the deaths of 8-year-olds Christopher Byers, Steven Branch and Michael Moore.

The judge also rejected Baldwin's claims that animals -- likely turtles -- caused multiple injuries to the boys' bodies. Burnett noted that the medical examiner who performed the autopsies was a turtle expert who said the injuries were caused by a knife.
Baldwin was sentenced to life in prison for the killings.

Jessie Misskelley is also seeking a new trial on the circuit level. We are still waiting to hear Judge Burnett's decision on that.

OK the same turtle expert that stated turtles don't feed underwater?  Bwahahaha  He actually wrote that??? Oh MY LOL

ooookkkk I would like to invite Dr. Peretti to come fishing with me in my pond.  It will be a long freaking day! There are no fish in our ponds due to the turtles.  I guess those darn fish kill themselves when they walk out on to the bank and are ambushed by them damn turtles!

I really didn't expect Burnett to rule any differently on this.  I expected him to deny so it goes on to federal and by the time it comes up, he felt he would already have his seat secured in the Senate.

  Maybe Burnett couldn't grant Jason a retrial without doing the same for Damien...but Jessie's case is different?
