Ya know, I kinda expected this from Burnett. But, it really just blows my mind that these bass-ackward idiots can continue to have this kind of power over other people's lives when a large portion of the world (not just the nation, but the world) knows that, at the very least, something is very wrong here. Is petitioning the governor not an option at this time? There has to be something more we can do. I am ready to blow a gasket just thinking about the degree of injustice that is being allowed to be committed against, not only the "three", but the boys and all their families.

(Sorry to laugh, musiclover...I couldn't hold back) The judge, the prosecutor, the medical examiner, the attorney general, and the governor are all part of the problem. Not one will ever go against the others. It's a broken machine that's going to have to be fixed by an outsider.

That being said Paid, is the Federal court the only option left? Someone once asked about the pres. I know that is a long shot, but I'd be willing to get on any kind of petition at this point. I hate sitting by and feeling helpless.

The ASS Court is a long-shot chance.
You have to understand how Arkansas works. These people don't give a shit about anything but protecting their careers. It's all about favors and working your way up the ladder. Going against the system is political suicide.
Judge Miller is a black Federal judge from Vanderbilt Law School. He's an outsider. That's what it's going to take....sorry to be so blunt, but that's the truth.

Let's just say that you won't see a black governor or attorney general in Arkansas in the foreseeable future.  That makes him an outsider. I'm still stunned that Burnett chose to hang his hat on the fact that Peretti claims to be a turtle expert. I'd almost be willing to bet that he "became" a turtle lover for the sole purpose of giving Burnett an out. They probably canceled Dr.Purpur's appearance after they instructed Peretti that he was going to assume the role of Turtle-expert extraordinaire.

From the Arkansas Times Blog; West Memphis Three: No new trialsMore later, but the breaking news is that a judge in Jonesboro has denied new trials for Jason Baldwin and Jessie Misskelley, who were convicted in the West Memphis Three murder case. No surprise. Judge David Burnett won't hurt his bid for state Senate by keeping the men in prison.. As appeals develop, it would be nice if the state Supreme Court actually allowed full public participation in the proceedings by opening critical sealed material considered in the appeals. If two men are to serve lives in prison and Damien Echols is to be executed, the public deserves to know everything the judge knew about allegations of jury tampering. ALSO: In a weird convergence of events, Burnett today DID commute a death sentence for another capital crime convict who had inadequate counsel at his trial. This defendant admitted killing a young woman who'd broken up with him. A statement follows from a group working for the West Memphis Three: Jason Baldwin, Jessie Misskelley and Damien Echols are innocent and should have their convictions overturned for crimes they did not commit. Judge David Burnett's decision only allows these tragic circumstances to continue. With all the new evidence of their innocence, including blatant jury misconduct, DNA linking others to the crime scene, forensic testimony from the country's leading pathologists and, what is universally recognized as a false confession, what more does it take to free these innocent men? It is time for justice in the courts of Arkansas. Right a terrible wrong. Overturn these convictions and find and prosecute those guilty of the murder of the three young boys in West Memphis in 1993. I know I am getting a little off from what I believe was "Raccoon" marks on the boys, (yes Paid I thought before I typed) but this on the expert (Peretti) on snapping turtles (snickering) I got this from this site http://www.austinsturtlepage.com/Articles/firstturtle.htm"Softshells can inflict a wicked bite; forum Admin. Chris H. had to have 6 stitches" Snappers are not the only carnivorous turtles found in Arkansas there many others but these are the to most likely to be found in or near water.

I agree that a snapping turtle could have been involved, but the animal hairs are hard to explain. Here are two excerpts from an article about snapping turtles: “ You could make a lot of money off that turtle. The police use them to find drowning victims. I was thinking that the defense objected to Peretti being considered a turtle expert in the Rule 37 Hearings and Burnett sustained the objection.
Now....Burnett all-of-a-sudden agrees that Peretti is an expert on turtles.
I hope that shows up in the transcripts.
